Terms & Conditions

1. Who we are
These Terms & Conditions (“Terms”) govern your access to and use of SparkCert (the “Service”).
By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
2. Eligibility
- You must be at least 16 years old to use SparkCert.
- You represent that you have the authority to agree to these Terms.
3. Your account
- You are responsible for all activity that occurs under your account.
- Keep your credentials secure and notify us immediately of any unauthorised use.
- We may suspend or terminate accounts that violate these Terms or pose security risks.
4. Acceptable use
When using SparkCert, you agree that you will not:
- Violate any applicable laws or regulations (UK or international).
- Infringe or misappropriate intellectual property, privacy, or other rights.
- Upload, post, or transmit malicious code, malware, or harmful content.
- Attempt to probe, scan, or test the vulnerability of the Service or its systems.
- Access or scrape the Service by automated means without permission.
- Misrepresent your identity or affiliation, or interfere with other users’ use of the Service.
5. Intellectual property
- All rights, title, and interest in the Service, including software, text, graphics, logos, and trademarks, are owned by SparkCert or its licensors.
- We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your lawful personal or internal business purposes.
- You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law.
6. Your content
- You retain ownership of content you submit to the Service.
- You grant SparkCert a worldwide, non-exclusive licence to host, process, and display your content solely to operate and provide the Service.
- You are responsible for ensuring your content complies with these Terms and applicable laws.
7. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect and process personal data.
By using the Service, you acknowledge the Privacy Policy.
8. Third-party services
The Service may contain links to, or integrate with, third-party services (e.g., authentication, analytics).
We are not responsible for third-party content, policies, or practices. Use of such services is at your own risk and may be subject to separate terms.
9. Availability and changes
- We aim to keep SparkCert available, but do not guarantee uninterrupted or error-free operation.
- We may modify, suspend, or discontinue all or part of the Service at any time with or without notice.
- Beta or experimental features may be offered “as is” and may change or be withdrawn at any time.
10. Fees
If SparkCert offers paid features or plans, pricing and payment terms will be provided separately. Unless stated otherwise:
- Fees are payable in advance and are non-refundable to the fullest extent permitted by law.
- We may change prices on renewal; any changes will be communicated in advance.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties,
whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
- Nothing in these Terms limits or excludes liability for death or personal injury resulting from negligence, fraud, or fraudulent misrepresentation.
- Subject to the above, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or loss of profits, data, goodwill, or business interruption.
- To the extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms shall not exceed the greater of £100 or the total fees paid by you to SparkCert in the 12 months preceding the claim.
13. Indemnity
You agree to indemnify and hold harmless SparkCert and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your breach of these Terms or applicable laws.
14. Termination
- You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
- We may suspend or terminate access immediately if you breach these Terms, create risk or legal exposure, or if required by law.
- Upon termination, your licence to use the Service ends. Sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law) will survive termination.
15. Notices
We may provide notices by posting within the Service or by email to the address associated with your account. You are responsible for keeping your contact details up to date.
16. Governing law & jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident in the UK may bring claims in their local courts to the extent required by consumer law.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new Terms on this page and update the effective date above.
If changes are material, we may provide additional notice (e.g., email or in-app).
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Miscellaneous
- Entire agreement: These Terms constitute the entire agreement between you and SparkCert regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
- No waiver: Our failure to enforce any provision is not a waiver of our rights.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations as part of a merger, acquisition, or sale of assets.
